You retain 100% full ownership of your audio streams, custom notes, and generated intelligence. PrestigeListens processes your audio ephemerally and will never use your private data to train public AI models. You agree to utilize this platform solely for lawful purposes and adhere strictly to applicable audio recording and consent laws.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "You") and PrestigeListens Inc. ("PrestigeListens," "we," "us," or "our"). By registering for an account, accessing our website, initiating an audio feed, connecting to our WebSockets, or using our software applications (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by all of the terms, conditions, and notices contained herein.
To use PrestigeListens, you must be at least 18 years of age or possess legal capacity under the laws of your jurisdiction. If you represent an entity or organization, you warrant that you possess full corporate authorization to bind that entity. You are strictly responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
PrestigeListens provides automated real-time speech intelligence, low-latency neural speech-to-text transcription, acoustic tone and conviction analysis, topic segmentation, automated summarization, and webhook synchronization. You acknowledge that algorithmic outputs depend upon input stream quality, acoustic fidelity, speaker volume, and network connectivity.
Customer Ownership: As between you and PrestigeListens, you retain all right, title, and interest (including all intellectual property rights) in and to any audio files, live streams, recordings, prompts, or text feeds submitted to the platform ("Customer Content"), as well as any resulting transcriptions or private analytical outputs generated exclusively for you.
License to PrestigeListens: You grant PrestigeListens a non-exclusive, worldwide, royalty-free, limited license solely to ingest, decode, transcribe, process, and transmit Customer Content to the extent necessary to deliver the Service to you and satisfy technical pipeline execution. PrestigeListens does not sell, license, or monetize Customer Content.
Billing Cycles: Paid subscriptions (Starter, Pro, Pro Plus, and Enterprise) are billed in advance on a recurring monthly or annual basis via our PCI-DSS Level 1 certified billing partner. Subscriptions automatically renew unless cancelled prior to the end of the current billing cycle.
Free Trials: If you enroll in a free trial, your account will automatically transition into the designated paid subscription plan at the end of the trial period unless cancelled beforehand through your Account Settings.
Refund Policy: Except where required by applicable consumer law, subscription fees and bandwidth usage fees are non-refundable. You may cancel your subscription at any time; cancellation takes effect at the expiration of the active billing period.
You agree not to utilize the Service in any manner that violates applicable federal, state, local, or international laws. We reserve the immediate right to suspend or terminate any account found engaging in unauthorized wiretapping, deceptive voice impersonation, infrastructure abuse, or violations of our Acceptable Use Policy without liability or refund.
While PrestigeListens strives for 99.99% system availability across our edge-routed neural infrastructure, we do not warrant that the Service will operate entirely uninterrupted, error-free, or devoid of latency anomalies caused by upstream internet service providers or third-party broadcast origins.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, ALL TRANSCRIPTIONS, SENTIMENT GAUGES, KEY TAKEAWAYS, AND ANALYTICAL METRICS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PRESTIGELISTENS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, GOODWILL, OR TRADING LOSSES) ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PRESTIGELISTENS' TOTAL AGGREGATE LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU TO PRESTIGELISTENS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
You agree to defend, indemnify, and hold harmless PrestigeListens, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Content; (b) your violation of these Terms; (c) your violation of any third-party right, including privacy, publicity, or intellectual property rights; or (d) your violation of any federal, state, or international audio recording, wiretapping, or eavesdropping statute.
These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute, claim, or controversy shall be resolved exclusively through final and binding confidential arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. YOU AGREE THAT ALL DISPUTES MUST BE RESOLVED ON AN INDIVIDUAL BASIS AND EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE PROCEEDING.
We reserve the right to modify these Terms at any time. When modifications are material, we will provide at least 15 days' notice by updating the revision date and posting a notice within the platform or dispatching an email notification. Continued use after changes become effective constitutes acceptance.
